In Brief
A widow inherited property from her late husband and gifted it equally to her three daughters in 1951 under a registered deed. One daughter (Basant Kaur) later died, leaving a will in favour of her husband (Ram Kishan), who sued for his 1/3 share. The other two daughters (Basant's sisters and original defendants) claimed the property reverted to them as heirs. The Supreme Court upheld the lower courts' decree in Ram Kishan's favour, holding that the mother's gift to all three daughters constituted a binding family arrangement. Since all daughters accepted and benefitted from the gift, they were estopped from later challenging it. The widow's gift was valid under Punjab's customary Hindu law, making Ram Kishan the rightful owner of the 1/3 share through his wife's will."
