Daya Nand vs Virmo Devi

Bench: 2 — Kurian

In Brief

A tenant aged 78 years challenged an eviction order passed by the Rent Controller and upheld by the High Court. The tenant argued that the respondent was not the owner of the premises. The Supreme Court, noting concurrent findings against the tenant, declined to interfere with the High Court's judgment. However, considering the tenant's advanced age, ill health, and long occupation of the premises since 1986, the Court granted him time until 31 December 2019 to vacate, rather than ordering immediate eviction.
