A landlord sought to evict a tenant on three grounds: arrears of rent, nuisance, and need for reconstruction. The Trial Court and First Appellate Court both allowed the eviction. The High Court remitted the case, holding that the Trial Court should have ascertained whether the tenant would reoccupy after reconstruction. The Supreme Court allowed the appeal and restored the lower courts' decrees. Where arrears of rent are established and undisputed, eviction can be sustained on that ground alone; the procedural requirement to test willingness to reoccupy after reconstruction does not become necessary once a separate ground for eviction is conclusively proven.
