The landlord sought eviction of the tenant on three grounds: arrears of rent, nuisance, and need for reconstruction. The Trial Court allowed eviction on the first two grounds, which the First Appellate Court affirmed. The High Court remitted the matter, holding that the Trial Court should have ascertained whether the tenant would reoccupy after reconstruction. The Supreme Court allowed the appeal, holding that once eviction on the ground of arrears of rent is concurrently found and established, the statutory requirement to ascertain the tenant's willingness to reoccupy after reconstruction becomes unnecessary. The Court restored the original judgment for eviction."
