Delhi Development Authority appealed against a High Court judgment declaring a land acquisition lapsed under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The respondents' property had been awarded for acquisition more than five years before the 2013 Act commenced, but neither physical possession was taken nor compensation paid. The Supreme Court dismissed the appeal, holding that the DDA did not dispute the factual finding of non-possession before the High Court and therefore could not raise it for the first time in the Supreme Court.
