Delhi Subordinate Services Selection Board vs Praveen Kumar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Delhi Subordinate Services Selection Board challenged a High Court order directing it to give age relaxation to Praveen Kumar for the post of Teacher (Primary) in MCD Schools. The respondent had claimed eligibility based on a prior judgment in Sachin Gupta's case, which granted one-time age relaxation to candidates affected by a sudden reduction in age limits. The Supreme Court held that the Sachin Gupta judgment was limited to that specific 2008 recruitment process and could not be extended to the respondent, who applied in a fresh 2009 advertisement. The Court allowed the appeal, finding that the High Court failed to appreciate the temporal and limited scope of the earlier judgment.
