Dharam Singh vs Punjab State Electricity Board and Ors

Bench: 2 — Kurian

In Brief

Dharam Singh was employed as a labourer from 1983, terminated in 1986, but an Industrial Dispute Award in 1994 ordered his reinstatement as a work-charge Chowkidar with continuity of service. The Punjab State Electricity Board declined to count his service towards the 2555-day requirement for appointment as Assistant Lineman. The Supreme Court held that the continuity of service granted by the Labour Court Award was valid, and the combined service period met the qualification requirement. The appeal was allowed and the Board was directed to consider Singh's appointment treating him as qualified with the requisite 2555 days of service.
