Firaoz Gani Mujawar vs State of Maharashtra

Bench: 2 — Sanjay Kumar, Alok Aradhe

In Brief

Firaoz Gani Mujawar was convicted of murdering Biru Lakshman Pujari, who sustained injuries and died fifty-one days later from septicaemia (a post-operative complication). The High Court upheld the conviction under Section 302 IPC (murder). The Supreme Court modified the conviction to Section 304 Part I IPC (causing death by negligence/rashness) and reduced the sentence to ten years rigorous imprisonment. The Court held that the injuries, though inflicted by the appellant, were not in the ordinary course of nature sufficient to cause death; death resulted from a post-operative infection rather than the injuries themselves.
