Food Corporation of India vs Pratap Kundu

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Food Corporation of India appealed a Division Bench order directing wage determination for casual labourers. The Supreme Court held that casual labourers are entitled to wages at Court-specified rates, and the FCI is liable to pay these wages directly. The FCI is not liable for profit determination or contractor commission on labour supply. The Court partly allowed the appeal, restricting remand to wage calculation only and quashing the direction to determine the contractor's profit earned.
