Govt. of NCT of Delhi & Anr vs Anand Arya & Ors

Bench: 3 — A.K. Sikri

In Brief

The Government of Delhi and Delhi Transport Corporation appealed against the High Court's rejection of their plea for extension of time to amend the Master Plan 2021 to accommodate the Millennium Bus Depot at its current location near Nizamuddin Bridge. The Depot, serving 10 lakh commuters daily, was constructed on land designated as 'River Water Body' in violation of the Master Plan. The Supreme Court held that while legal compliance with the Master Plan is mandatory, the intervening National Green Tribunal order for floodplain identification by experts raised factual uncertainties. Balancing public interest against environmental concerns, the Court granted one final one-year extension for the DTC to amend the Master Plan or relocate, with an absolute bar on further extensions."
