Delhi Development Authority vs Nirmal Kanta Kohli and Ors

Bench: 2 — Kurian

In Brief

The Delhi Development Authority appealed against orders affecting its land acquisition proceedings. The Supreme Court held that under the 2013 Land Acquisition Act, when prior acquisition fails, an authority may initiate fresh proceedings under Section 24(2). However, it must do so by issuing proper Notification under Section 11 within a set period. The Court dismissed the appeal but granted DDA one year to initiate fresh proceedings. If no such proceedings are begun within that period, the land must be returned to its original owner.
