Hemraj Garg and another appealed against a High Court order passed without hearing them, dated 22.07.2016, in proceedings relating to Vishranti City Residents Welfare Society. The Supreme Court held that such ex parte orders violate natural justice principles. The appeal was partly allowed: the appellants were directed to seek impleadment in the pending High Court proceedings and file applications for modification of the impugned order within two weeks. The High Court was requested to hear the parties and pass fresh orders within three months. An interim order granted by the Supreme Court would remain operative until fresh orders were issued. No costs were awarded.
