The Supreme Court found this reasoning flawed: Akhtar's date of birth (20.1.1955) meant he would attain age 65 only on 20.01.2020, well after his extended tenure ended on 16.8.2018. The Court allowed the appeal and remanded the matter to the High Court to examine all grounds of challenge raised by the respondent, particularly whether the appointment violated Statute 3.02's requirements regarding the selection process.
