Jewellers Khanna Sons vs Naresh Mittal & Ors

Bench: 2 — Kurian

In Brief

A jewellery company challenged an interim order of the Punjab and Haryana High Court that fixed mesne profits (damages for wrongful occupation) at Rs. 1,00,000 per month pending a civil revision petition. The Supreme Court allowed the appeal and modified the interim order, reducing the monthly deposit to Rs. 50,000 effective from the date of the original application (19.12.2011) rather than the interim order date. The deposit was to continue until the High Court disposed of the revision petition finally. The Court requested expeditious disposal and permitted respondents to withdraw deposited amounts, with any excess being adjusted against future payments."
