K. AMARNATH REDDY vs CHAIRMAN & M.D. A.P.S.P.D.C.L.LTD.&ORS.E

Bench: 2 — L. Nageswara Rao, Sanjay Kishan Kaul

In Brief

The Supreme Court addressed the validity of appointments of Junior Linemen in Andhra Pradesh power sector entities. A Division Bench of the High Court had approved appointments of 7114 Junior Linemen in 2009 and directed additional appointments for candidates excluded due to a struck-down condition. The same High Court later re-examined these selections and issued directions setting aside various appointments. The Supreme Court held that the High Court erred in re-adjudicating a final Division Bench judgment. Once appointments were made pursuant to that judgment and services regularized, they could not be disturbed. The Court allowed the appeal, set aside the High Court judgment, and clarified that candidates who applied in 2006 but remained unappointed would be considered.
