K-Link Healthcare (India) Pvt. Ltd vs State of Kerala and Ors

Bench: 2 — Kurian

In Brief

K-Link Healthcare (India) Pvt. Ltd appealed against the High Court's refusal to quash an FIR filed under the Prize, Chits and Money Circulation Schemes (Banning) Act, 1978, and to unfreeze its bank accounts. The Supreme Court found that during the appeals, the investigation was completed and a final police report was filed. Rather than decide the merits, the Court disposed of the appeal by remitting the matter back to the High Court, permitting the appellant to file fresh proceedings under Section 482 Cr.P.C. or Article 226 on the grounds that the final report disclosed no offence, so the High Court could reconsider uninfluenced by its earlier observations.
