K-Link Healthcare (India) Pvt. Ltd vs State of Kerala and Ors

Bench: 2 — Kurian

In Brief

K-Link Healthcare appealed against the High Court's refusal to quash a criminal FIR and unfreeze bank accounts frozen during investigation. The investigation was later completed with a final report disclosing no offence. The Supreme Court held that while declining to express opinion on merits, the appellant should be permitted to file a fresh petition before the High Court under Section 482 Cr.P.C. or Article 226, which should be considered afresh without being influenced by the earlier order, given the material change in circumstances following investigation completion.
