In Brief
This case concerns the acquisition of land in Delhi for public purposes under the Land Acquisition Act, 1894. A private school operator challenged the acquisition of 13.3 acres and sought exclusion of the school premises. The Supreme Court held that once possession of acquired land is deemed taken over pursuant to an undertaking, the entire property transfers to the acquiring authority without any exclusion. The school must be handed over to the Delhi Government. The Court dismissed all applications seeking extension of time to run the private school and refusal to hand over any portion of the acquired land.
