The Kerala State Electricity Board and others appealed against a Division Bench judgment quashing a tariff notification that differentiated between Government-run/aided educational institutions and Self-Financing Educational Institutions (SFEIs). The Supreme Court held that once a tariff proposal is published without objection, reasons need not be disclosed at the stage of finalisation. Regarding the core issue, the Court found the differentiation legally justified, as SFEIs' commercial nature distinguishes them from Government institutions. The Court rejected the argument that both categories serve similar educational purposes, stating no error was committed in fixing higher tariff for SFEIs. The judgment was set aside and the original decision restored.
