The appellants sought enhancement of compensation in a land acquisition case but were rejected by the High Court solely on the ground of delay in filing. The Supreme Court held that in enhancement of compensation claims, delays should be condoned leniently if claimants are denied statutory benefits for that period. The Court condoned the delay on condition that the appellants forfeit statutory benefits for the delay period, and remitted the case to the High Court for merit-based consideration of the enhancement claim."
