Kuldeep Singh vs State of Maharashtra and Others

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellant sought a fresh F.I.R. and Special Investigation Team for the death of his brother in a police encounter. The original F.I.R. alleged the brother fired at police, but the appellant contested this. The Court held that the investigating agency may conduct a fair investigation and determine the true facts even without registering a separate F.I.R., as long as the investigation is not confined to the original version. The Court noted that Section 176(1-A) magisterial enquiry applications could still be pursued separately before the concerned magistrate.
