In Brief
A man sought Supreme Court direction for registration of a new F.I.R. after his brother died in an alleged police encounter in Mumbai. The original F.I.R. described the death as a lawful police shooting in self-defence. The appellant claimed it was unlawful murder and sought a fresh investigation. The High Court declined, finding an F.I.R. already registered. The Supreme Court held that no fresh F.I.R. is legally required; the investigating agency can pursue the correct facts and proper investigation even without re-registering the case, provided it acts on the true version. The Court found investigation was proceeding on the appellant's version and offences had been registered against the police officials. The appeal was disposed of accordingly.
