Land Acquisition Officer, Andhra Pradesh vs Ravi Santosh Reddy (D) By L.Rs

Bench: 2 — Abhay Manohar Sapre

In Brief

The State of Andhra Pradesh acquired land from the respondents' predecessor under the Land Acquisition Act, 1894 for a railway project. After a Lok Adalat settlement enhanced the compensation awarded to the landowners, the executing court issued a warrant for attachment of the State's movable property to recover outstanding interest on the delayed payment. The State sought to recall this order, but the executing court and High Court both dismissed the application, holding that since the main compensation order was never challenged, it had attained finality. The Supreme Court upheld both lower courts, finding no error and noting the matter involved only a minor interest calculation, not a substantial legal issue. The State was directed to pay all outstanding decreetal amounts including costs within three months."
