Supreme Court of India 2018-12-07 remanded

Lokamani & Ors vs Mahadevamma & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court identified a conflict of opinion between two Division Bench judgments—Prakash v. Phulavati (2016) and Danamma v. Amar (2018)—regarding the interpretation of Section 6 of the Hindu Succession Act, 1956 as amended in 2005. Under Supreme Court Rules, 2013, Order VI Rule 2, such conflicts require referral to the Chief Justice for constitution of a larger bench. The Court directed the Registry to place the matter before the Chief Justice for appropriate bench constitution to resolve the conflicting interpretations."
