In Brief
In this civil appeal, the Court identified a conflict of opinion between two Division Bench judgments (Prakash v. Phulavati and Danamma v. Amar) concerning the interpretation of Section 6 of the Hindu Succession Act, 1956 as amended in 2005. Rather than proceeding with adjudication, the Court invoked procedural rules requiring referral to the Chief Justice for constitution of an appropriate Bench to resolve the conflicting judicial precedents and clarify the law on this important question of succession rights.
