M.K. Jain (dead) thr. Lrs vs Principal Secretary, State of Uttar Pradesh & Ors

Bench: 2 — Kurian

In Brief

In this appeal, the termination of M.K. Jain, a deceased employee of a Nigam (statutory body) that was wound up in 2000, was challenged by his legal heirs. The employee had been terminated following an inquiry. The Supreme Court upheld the inquiry findings and did not interfere with the termination. However, recognizing the rights of the legal heirs, the Court directed the State to verify within three months whether the deceased was paid all dues, including subsistence allowance during suspension. Any shortfall shall be paid to the heirs with 18% per annum interest within a month thereafter. The appeal was disposed of accordingly."
