M.P. Poorva Kshetra Vidyut Vitaran Co. Ltd. & Ors vs Uma Shankar Dwivedi

Bench: 2 — Kurian

In Brief

A power distribution company and its subsidiary argued they were not obligated to extend Fifth Pay Commission benefits to employees absorbed from the Rewa Rural Electrification Cooperative Society. The Supreme Court held that once the company extended such benefits to similarly situated employees from other REC Societies, all absorbed employees must receive equal treatment. The company must implement Sixth and Seventh Pay Commission recommendations for REC employees effective from when its own staff received them, with any arrears payable within three months.
