Four men were convicted of murdering Jitu Mahto during a land dispute in 1985. The accused arrived armed at a field where Jitu Mahto was working, fired gunshots causing three workers to flee, but trapped Jitu Mahto who was assaulted with a tangi and stones resulting in his death. Eyewitness testimony from two survivors, corroborated by a postmortem report, clearly identified each accused's role. Both the trial court and high court upheld the convictions under Section 302 with Section 34 IPC for common intention. The Supreme Court, applying established appellate principles, found no perversity in the concurrent findings and dismissed the appeal.
