A dispute at a madrassa between committee members over removing the earlier Khateeb escalated into violence. Accused persons stabbed the deceased and his brother multiple times with a dagger. The appellants denied the incident when examined under section 313 CrPC. The trial court convicted them under section 302 read with section 149 IPC and other provisions; the High Court upheld conviction under section 302 read with section 34 IPC. The appellants challenged this, arguing the post-mortem showed no injuries matching all accused. The Supreme Court held that when accused share common intention to cause bodily injury sufficient to cause death in the ordinary course of nature, section 34 IPC applies to all, regardless of which accused inflicted which injury. Appeal dismissed and bail cancelled.
