In Brief
In a land acquisition case under the Land Acquisition Act 1894, appellants challenged the compensation of Rs. 110 per sq.meter for their 16,631 sq.meter property. Adjoining properties of similar cluster (7,598 and 5,440 sq.meters) had been awarded Rs. 130 per sq.meter. The appellants' land had the additional advantage of road frontage. The Court held that on the principle of parity, adjoining lands in the same cluster should ordinarily receive equal compensation despite area differences, especially where one property has a compensating advantage. The appeal was partly allowed: appellants entitled to Rs. 130 per sq.meter with statutory benefits.
