In Brief
A teacher was appointed initially for a fixed 10-month period against a permanent teaching vacancy and was later discontinued. The School Tribunal held the discontinuance illegal and ordered reinstatement with all benefits. The Supreme Court upheld reinstatement but modified the award. Since the appointment was against a permanent vacancy (a critical distinction) and the employee had been out of service for over 25 years and would soon reach superannuation, the Court granted reinstatement with continuity of service and all benefits except backwages for the period not worked.
