In Brief
A teacher initially appointed for 10 months against a permanent vacancy was discontinued from service. The School Tribunal found the discontinuance illegal and ordered reinstatement with full benefits. The management challenged this before the High Court, which dismissed the petition. The Supreme Court partly allowed the management's appeal. It held the appointment was against a permanent post and thus illegal discontinuance occurred. The teacher was reinstated with all service benefits and continuity of service, but backwages for the period not worked were denied, considering he had been out of service for 27 years and would retire in 2019.
