Modern Institute of Medical Sciences vs Union of India & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Modern Institute of Medical Sciences challenged the Ministry of Health's decision to debar it from admitting MBBS students for 2017-18 and 2018-19 and to encash its bank guarantee. The Supreme Court allowed the petition, directing that students already admitted on conditional permission continue their studies, MCI conduct inspection, and the 2017-18 renewal application be treated as one for 2018-19. The Rs. 2 crore bank guarantee shall not be encashed pending the Ministry's final decision, which must be taken within one month after consultation with a structured hearing committee. The institution is entitled to cure identified deficiencies within reasonable time before any adverse order.
