A police officer challenged his non-inclusion in a 2001 promotion list for Deputy Superintendent of Police. Though initially barred by rule, he was later given notional promotion effective 2001, which affected another officer's seniority. The Supreme Court held that an officer may challenge such decisions if they directly affect his seniority position. Crucially, the Court ruled that a punishment imposed in 1997 spanning two years with cumulative effect—continuing into the 1998-2000 check period—could validly be considered by the promotion committee. The High Court erred in disregarding this continuing effect. The Court revived the earlier government order and directed restoration of proper seniority as of 2005, within three months.
