An employee promoted as Headmaster in 2007 declined the posting due to inconvenience and was later promoted again in 2010. His 2010 promotion was then cancelled based on an office order citing his 2007 refusal. The employee was charged with misconduct. The question was whether rules amended in January 2010 could be applied to penalize his conduct from 2007. The Supreme Court held that the employee cannot be penalized under rules that did not exist when he declined the 2007 promotion, restoring the Single Judge's order and allowing the appeal.
