Municipal Corporation of Greater Mumbai vs Mohammed Ashraf Abdul Karim Kapadia

Bench: 2 — Kurian

In Brief

The Municipal Corporation of Greater Mumbai appealed against the High Court's dismissal of its first appeal solely on the ground of a 34-day delay in filing. The Supreme Court examined the condonation affidavit and, after hearing both parties, held that the delay was liable to be condoned. The Court accordingly condoned the delay and directed the High Court to admit and take the first appeal on record, disposing of the Special Leave Petition petition.
