Murlidhar & Ors vs State of Rajasthan

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellants were convicted under Sections 323 and 324 of the Indian Penal Code (offences involving simple and voluntarily causing hurt) and sentenced to one year's imprisonment for involvement in a clash between two groups causing simple injuries. The Supreme Court found that the appellants arrived at the scene only towards the end of the incident after hearing noise, and could not be said to have formed part of an unlawful assembly. Accordingly, the Court modified the sentence to the period already undergone (approximately 45 days), allowing the appeals on the basis that fuller justice would be served by this reduced sentence.
