Murlidhar & Ors vs State of Rajasthan

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court reviewed convictions of appellants under Sections 323 and 324 of the Indian Penal Code for violent acts. While affirming the concurrent findings of guilt by lower courts, the Court found the appellants had arrived at the incident scene only after hearing noise and participated in a spontaneous clash causing simple injuries. Crucially, they did not form an unlawful assembly. The Court reduced their sentence from one year imprisonment to the period already undergone (approximately 45 days), exercising discretion to serve justice more fairly given the circumstances of their involvement.
