In Brief
A public servant was terminated in 1997 after 10 years of regular and 14 years of adhoc service without consulting the Public Service Commission, as required by service rules. The Administrative Tribunal and High Court set aside the termination as illegal. The Supreme Court upheld this decision but modified the relief: the employee is entitled to retiral benefits with the period from termination to superannuation (reached in 2004) counted as notional service for pension purposes only, with no actual backwages for that period. Benefits were to be computed and disbursed within three months.
