Nagar Nigam, Kanpur Nagar & Ors vs Brijbala Tewari (Dr.) & Anr

Bench: 2 — Kurian

In Brief

A municipal official with over 24 years of service (10 regular, 14 adhoc) was terminated in 1997 without consulting the Public Service Commission as required by service rules. The Administrative Tribunal and High Court set aside the termination as procedurally invalid. The Supreme Court upheld the order but held that the respondent was not entitled to full back wages. Instead, the service period from termination to superannuation (2004) was treated as notional, credited only for pension calculations. The Court directed computation and disbursement of retiral benefits within three months, granting neither actual back wages nor salary restoration for the intervening period."
