Dr. Jacob Thudipara vs The State of Madhya Pradesh & Ors

Bench: 2 — M. R. Shah, B. V. Nagarathna

In Brief

Dr. Jacob Thudipara, a teacher in a government-aided private college, sought superannuation benefits at age 65, like government college teachers. His earlier writ appeal was dismissed by the High Court based on a now-overruled precedent. This Court set aside that precedent, holding that aided college teachers are entitled to enhanced superannuation at 65 years with full arrears. The State argued no payment was due for periods when the teacher didn't work. The Court rejected this, finding that when the State unlawfully prevented the teacher from serving despite legal entitlement, denying benefits violated equality. The appeal was allowed with arrears payable within six weeks.
