In Brief
An insurance company appealed a workers' compensation award made to an employee who lost his left foot and part of his right foot in a workplace accident on 30 December 2003. The Employees' Compensation Commissioner found the worker was 100% functionally disabled and unable to continue his work as a painter, awarding him Rs. 5,20,584 in compensation. The Supreme Court dismissed the appeal, finding no substantial questions of law were raised. The Court noted the compensation had already been paid to the impoverished worker and was irrecoverable even if the appeal succeeded."
