Drivers appealed against a High Court judgment dismissing their writ petition seeking fixation of Selection Grade and Special Grade pay scales on the basis of equal treatment. The Supreme Court upheld the High Court's decision, holding that Article 14 cannot be used to claim a benefit when one is not lawfully entitled to it. The Court clarified that Article 14 guarantees positive equality, not negative equality, and cannot perpetuate illegality or irregularity. Since the appellants were found not to be lawfully entitled to the claimed pay scales, they could not invoke Article 14 for relief. The appeals were dismissed.
