The appellant was convicted of causing death by assault under Section 304 IPC and sentenced to life imprisonment by the trial court, upheld by the High Court. The Supreme Court allowed the appeal, modifying the conviction to Section 304 Part-I IPC with a sentence of rigorous imprisonment for 10 years. The Court found that although one of two injuries proved fatal, the victim survived over 11 days and died from complications (septicemia and peritonitis) during hospital treatment, warranting a lower conviction and reduced sentence than life imprisonment."
