The Supreme Court allowed the appeal, holding that the appellant was not a hardened criminal and the incident had occurred spontaneously during a pleasure trip. Since the co-accused had already been granted bail and a final report had been filed, the Court found it just and proper to release the appellant on bail pending trial, subject to execution of a personal bond and sureties.
