In Brief
The Supreme Court addressed land acquisition compensation for agricultural land in village Dholakuva that had been transferred to the State PWD in 1966 and later acquired for the Infocity project. The landowners challenged the High Court's reduction of compensation from Rs. 3,500/- to Rs. 770/- per square meter. The Court restored the Reference Court's award of Rs. 3,500/- per square meter, finding the High Court's reliance on concessional Infocity allotment rates unjustified when better evidence existed, including expert assessments and comparable government rates. The Court also upheld the High Court's award of rent compensation for unauthorized occupation from 1966 to 2002, thereby partly allowing the landowners' appeal and dismissing the Special Land Acquisition Officer's appeal on rent compensation."}
