R.R. INAMDAR vs THE STATE OF KARNATAKA

Bench: 2 — D.Y. Chandrachud, Ajay Rastogi

In Brief

A Scheduled Caste woman teacher was promoted to the solitary post of Lecturer in English in a high school based on roster points. Her senior colleague challenged the appointment, arguing it was improper to reserve a single post. The High Court upheld this challenge. The Supreme Court affirmed that reservation cannot apply to a solitary post, as doing so would violate the constitutional bar against 100% reservation. However, the Court directed the State of Karnataka to consider creating an additional or supernumerary post to accommodate the appellant, and allowed the appellant to continue working without recovery of salary. The senior colleague would be promoted to the post with notional pay adjustment.
