The Supreme Court upheld the selection process for Assistant Teachers in Uttar Pradesh following ATRE-2019. The Court held that B.Ed. candidates were rightly eligible for appointment as the NCTE Notification conferring such eligibility is binding on the State. The Court also validated the fixation of minimum qualifying marks at 65-60%, even though declared after the examination, as the Government has power to determine such marks 'from time to time' under the 1981 Rules. The Court rejected arguments that Shiksha Mitras (para-teachers) from consecutive examinations formed a homogeneous class, noting that different examination formats and difficulty levels create separate competitive pools. All appeals by Shiksha Mitras, ex-servicemen, and other candidates were dismissed, allowing the State to fill the positions according to the declared results."
