Raman Singh vs District Inspector of Schools, Jalaun at Orai & Ors

Bench: 2 — 2

In Brief

The appellant, appointed on an ad-hoc basis to fill a temporary leave vacancy in an aided educational institution, sought to have his appointment converted to a permanent substantive position and claimed salary entitlement. The Supreme Court held that an ad-hoc appointment carries no inherent right to permanent absorption, especially where the District Inspector had previously rejected such absorption as unlawful. The Court directed that the vacant post be filled through regular procedures within four months, while allowing the management to pursue its representations in accordance with law. The appeal was disposed of accordingly.
