The appellant sought salary approval for his appointment to a teaching position by an educational institution's management in Uttar Pradesh. The dispute turned on whether the Management was authorized to make substantive appointments. The Supreme Court held that the Management's authority to appoint was limited and circumscribed by the UP Secondary Education Services Commission and Selection Boards Act, 1982. The appointment did not comply with paragraph 5 of the Removal of Difficulties Order, and therefore the appellant could not enforce a salary claim against the State. The appeal was dismissed.
